Carbon County court

A Carbon County woman was given a time-served sentence on a drug count.

She was one of five defendants who previously pleaded guilty sentenced on Monday by Judge Joseph J. Matika.

Prison incident

Holly Marie Getz, 37, of Palmerton, was sentenced to time-served, 343 days, to one day less 24 months on a charge of possession of a controlled substance. She will also serve two years of probation.

She was charged by Nesquehoning police for an incident on June 3, 2016, when she was found with heroin on her at the county prison.

Getz admitted to a long history of addiction. She has tried to address it by going to two inpatient programs, which she was given credit for along with 222 days spent in the county prison.

Additionally, she was ordered to render 100 hours of community service, get both a drug and alcohol and mental health evaluations and follow any recommendations for treatment and zero tolerance for drug and alcohol use.

Other cases

Samuel Francis Lakata, 22, of Weatherly, was placed on probation for three years on a charge of receiving stolen property, rated a felony three.

He was charged by Weatherly police for an incident in the 400 block of Plane Street on Nov. 9, 2015, in which he removed old coins and jewelry from a home.

Matika also ordered him to make restitution of $6,038.20, supply a DNA sample, render 100 hours of community service and have no contact with the victim.

Taryn Lee Depos, 31, of Tamaqua, was placed on probation for a year on a charge of possession of drug paraphernalia.

She was arrested on Oct. 27, 2016, by Summit Hill police following a traffic stop. She was a passenger in the vehicle.

Depos told the court she has spent about a year in prison, finishing a jail term in Schuylkill County, then going to Northampton County. She said she has now finished with Northampton term and the Carbon case is the last she is facing.

Matika also ordered her to get a drug and alcohol evaluation, zero tolerance for drug and alcohol and render 50 hours of community service.

The term runs consecutive to the Northampton sentence.

Jevonne Ivan Torres, 22, of Hazle Township, Luzerne County, was sentenced to serve 30 days to one day less 24 months on three counts of criminal trespass.

He was charged on Aug. 4 by state police at Hazleton with entering a garage and two homes in Banks Township. Torres said he was homeless at the time and did not take anything from the residences.

Matika also ordered him to supply a DNA sample, get a drug and alcohol evaluation, render 75 hours of community service and have no contact with any of the victims.

Torres, who is an inmate in the county prison on the charges, was given credit for 72 days spent in jail and paroled.

Richard H. Curry, 31, of Effort, was placed on probation for six months on a charge of simple assault.

Kidder Township police charged him for an incident on June 26 along Laurel Woods Drive in Lake Harmony. Township police responded to the area for a report of a domestic incident. On scene officers learned that Curry had pushed the victim to the ground, causing injuries, including bleeding, which was observed by the officers.

Curry denied striking the girl and pushing her to the ground. He claimed she sustained the injuries when he pulled her from her vehicle.

Matika also ordered him to render 25 hours of community service and have no contact with the victim.

All the defendants must also pay court costs of about $1,000 and a $50 per month supervision fee while on probation or parole.
