Carbon County court — ARD

Three first-time offenders in the criminal justice system were placed in Carbon County’s Accelerated Rehabilitation Disposition probation program on Monday by Judge Steven R. Serfass.

If a person successfully completes all conditions of the program, their record will be wiped clean. However, if they fail to complete it, or are revoked from it, then they would face trial on all pending charges. A person does not admit guilt in entering the program.

Placed were:

Denom M. Krall, 38, of Albrightsville, was placed for two years on a charge of recklessly endangering another person and related counts. He was arrested on Nov. 7, 2017, in the county parking lot near the train station by Jim Thorpe police. Police responded to the area at the request of county sheriff deputies who reported a suspicious vehicle in the lot. Two firearms were found in the vehicle.

Krall was ordered to pay $450 for the cost of the program and to get both drug and alcohol and mental health evaluations and follow any recommendations for treatment, render 100 hours of community service and zero tolerance for drug and alcohol use.

Frederick Joseph McGill, 23, of Jim Thorpe, was placed for a year on a driving under the influence charge. He was arrested on Sept. 23, 2017, along Route 248 in Franklin Township by state police at Lehighton. A test revealed the presence of a controlled substance.

He was assessed $600 and ordered to render 50 hours of community service and his license was suspended for 60 days.

Evan James Palmer, 18, of Hatboro, Montgomery County, was placed for a year on a DUI charge. He was arrested on July 29, 2017, along Route 248 by Palmerton police. A test revealed the presence of a controlled substance.

He was assessed $600 and ordered to render 50 hours of community service and his license was suspended for 90 days.

Both McGill and Palmer must also follow any recommendation of their drug and alcohol evaluation.

All three must also pay court costs of about $1,000 and a $50 per month supervision fee while in the program.
