Carbon County court
A Carbon County man admitted to an assault count while two other defendants pleaded guilty to drunken driving charges on Monday in the county court.
Judge Steven R. Serfass accepted the pleas.
Penn Forest incident
Kenneth Diaz, 38, of White Haven, and formerly of Albrightsville, pleaded to one count of simple assault for an incident on Nov. 2, 2017, at his former residences in Albrightsville, Penn Forest Township.
State police at Fern Ridge responded to the home for a report of a domestic assault. On scene officers learned that Diaz was involved in an altercation with a 15-year-old boy and had pushed him into a kitchen cabinet, causing injuries.
Serfass sentenced him to time-served (41 days) to one year in jail and ordered he have no contact with the victim and render 50 hours of community service.
DUI pleas
Two defendants pleaded to driving under the influence charges.
Dennis Mendoza, 22, of Allentown, was arrested on July 15, 2017, along Second Street by Lehighton police. He also pleaded to one count of possession of drug paraphernalia. Police found drug paraphernalia in the vehicle following a consent search. A test revealed the presence of a controlled substance.
Serfass sentenced him to serve 72 hours to six months in jail, a fine of $1,000, one-year license suspension and must render a total of 75 hours of community service.
He began the jail term immediately.
Zachary Fischl, 29, of Tampa, Florida, and formerly of Northampton, was arrested on May 14, 2016, by state police at Lehighton along Route 209 in Franklin Township. A test revealed a 0.13 BAC.
Serfass sentenced him to serve five days to six months in jail, a fine of $300, one-year license suspension and render 25 hours of community service. He was given credit for four days spent in jail on the charge.
He will serve the remaining day beginning at 9 a.m. March 27.
Each defendant must also pay court costs of about $1,000 and a $50 per month supervision fee while on parole.
