A Carbon County man pleaded guilty on Monday in the county court to two counts of simple assault while another county resident, charged in a prostitution case, pleaded to a trespass count with prostitution charges being dropped by the district attorney’s office in a plea bargain. Judge Joseph J. Matika accepted the pleas.
David Allen Penberth, 47, of Lansford, admitted assaulting two females on June 19, 2017, at his residence.
He said the one female was an ex-girlfriend and the second her friend and was the result of an ongoing dispute.
Matika placed him on probation for 18 months on both counts, with the terms running consecutively, and ordered he attend and successfully complete an anger management course, render a total of 100 hours of community service and have no contact with either victim.
Harry John Murphy Jr., 38, of Coaldale, pleaded to one count of defiant trespass. Charges of criminal solicitation — promoting prostitution-loitering for purpose of prostitution, criminal conspiracy — promoting prostitution and possession of drug paraphernalia, were dropped in a plea agreement with the district attorney’s office.
He was arrested for an incident on Aug. 3, 2017, in the area of Dock Street and Edgemont Road. A co-defendant in the case, Christine Kieffer, failed to appear Monday for a plea hearing and had a bench warrant issued for her arrest.
Matika placed him on probation for a year and ordered he render 50 hours of community service.
Both defendants must also pay court costs of about $1,000 and a $50 per month supervision fee while on probation.
