Carbon man given prison term for fleeing police, driving under suspension
A Carbon County man was sentenced to a county prison term Monday after pleading guilty to fleeing police and driving under suspension.
Roberto Magobet, 39, of Jim Thorpe, pleaded to one count each of flight to avoid apprehension and driving under suspension, DUI related, for an incident on Jan. 12 along Fourth Street filed by Jim Thorpe police. He also pleaded to harassment for an incident on May 26, 2017, filed by Lansford police for an incident in which he was accused of assaulting his then girlfriend. In that case a simple assault count was dropped in a plea bargain.
Magobet is currently an inmate in the county prison serving a 120-day jail term for another DUI related driving under suspension charge.
Serfass sentenced him to serve three to 12 months in prison on the harassment charge, consecutive with his current sentence, and three to 60 months on the flight to avoid apprehension, also consecutive to the other charges. On the driving under suspension he was sentenced to serve 45 to 90 days in jail, but must serve the full 90, concurrent to the other charges.
He was also ordered to pay a fine of $500 on the suspension count, render a total of 100 hours of community service when released on parole, pay court costs of about $1,000 and pay a $50 per month supervision fee while on parole. He was given credit for 79 days spent in prison on the charges.
