Carbon County court — DUI

A Carbon County woman pleaded guilty on Friday to driving under the influence and endangering the welfare of a child charges.

She was one of four defendants in DUI-related cases to enter a plea before Judge Joseph J. Matika.

Lansford incident

Alyissa Ann Bernardi, 27, of Lansford, pleaded to the two counts which stem from an incident on Aug. 2.

Police were involved in a drug investigation and arranged for a confidential informant to make a drug buy from Bernardi. After the sale was made, police made a vehicle stop and found Bernardi was under the influence. They also found her with drugs hidden in her bra and a juvenile in the vehicle.

In exchange for the plea, the district attorney’s office dropped felony counts of possession with intent to deliver a controlled substance and criminal conspiracy to PWID along with two other drug counts.

Bernardi is currently an inmate in the county prison facing a probation revocation proceeding.

On the endangering count Matika sentenced her to serve one to 18 months in prison and on the DUI charge 72 hours to two years in jail followed by three years of probation, with the terms running concurrently. She was also ordered to get a drug and alcohol evaluation and follow any recommendation for treatment, zero tolerance for drug or alcohol use, attend and successfully complete a parenting class, pay a fine of $1,500, license suspended for 18 months and render 100 hours of community service when paroled.

On a charge of possession of drug paraphernalia, she was placed on probation for a year, concurrent with the other charges.

Other pleas

Penny Shelton, 52, of Summit Hill, was arrested on May 6 along Ludlow Street by Summit Hill police. She refused a test. She also pleaded to one count of possession of drug paraphernalia. A charge of resisting arrest was dropped in a plea bargain.

On the DUI count Matika sentenced her to serve 72 hours to six months in jail, a fine of $1,000, one-year license suspension and render 25 hours of community service. On the drug count she was placed on probation for six months, concurrent with the DUI charge, and ordered to get a drug and alcohol evaluation.

She will begin the jail term at 9 a.m. on Oct. 15.

Louis V. Clouser, 46, of Lansford, was arrested on Feb. 10 by Lansford police along Patterson Street. A test revealed a 0.13 BAC.

Sentencing was deferred so he can obtain a drug and alcohol evaluation.

Theodore Joseph Faenza, 64, of Summit Hill, was arrested on April 13 by Mahoning Township police along Route 443. A test revealed the presence of a controlled substance.

Sentencing was deferred so Faenza can apply for placement in the county’s Intermediate Punishment Program — house arrest.

Each defendant sentenced must also pay court costs of about $1,000 and a $50 per month supervision fee while on parole.
