Carbon County court — ARD

Ten defendants in pending criminal cases were placed in Carbon County’s Accelerated Rehabilitation Disposition probation program on Monday by Judge Joseph J. Matika.

If a person successfully completes all conditions of the program, their record will be wiped clean. However, if they fail to complete it, or are revoked from it, then they would face trial on all pending charges. A person does not admit guilt in entering the program.

All were placed for a year, unless otherwise noted.

Luis Kenneth Ayala, 45, of Brooklyn, New York, was placed on a driving under the influence charge. He was arrested on April 8 by Kidder Township police along Route 1003. A test revealed a 0.13 BAC.

He was assessed $500 for the cost of the program and ordered to render 50 hours of community service and his license was suspended for 60 days.

Jonathan R. Boyles, 28, of Albrightsville, was placed on a DUI charge. He was arrested on April 26, 2017, by Kidder Township police along Route 534. A test revealed a 0.18 BAC.

He was assessed $550 and ordered to render 50 hours of community service and his license suspended for 60 days.

Triana Maria Espinal, 21, of Providence, Rhode Island, was placed on a DUI charge. She was arrested on Jan. 1 along Banks Avenue in Banks Township by state police at Hazleton. A test revealed a 0.11 BAC.

She was assessed $500 and ordered to render 50 hours of community service and her license suspended for 90 days.

Abdulqaadir Holloman, 21, of Philadelphia, was placed for two years on a charge of possession with intent to deliver a controlled substance and related drug charges. He was arrested on April 28 by Kidder Township police along Route 940 following a vehicle stop. Marijuana was found.

He was assessed $650 and ordered to get a drug and alcohol evaluation and follow any recommendation for treatment and render 100 hours of community service.

Daniel Hutta, 18, of Jim Thorpe, was placed on a DUI charge. He was arrested on April 29 along Route 902 by Lansford police. A test revealed the presence of a controlled substance.

He was assessed $600 and ordered to render 50 hours of community service and his license suspended for 90 days.

Melissa Johnson, 53, of Tamaqua, was placed on a charge of possession of a small amount of marijuana. She was arrested on June 24 by Lansford police along West Ridge Street.

She was assessed $450 and ordered to get a drug and alcohol evaluation and render 50 hours of community service.

Sean Patrick Joyce, 30, of Point Lookout, New York, was placed on a DUI charge. He was arrested on Feb. 9 along Route 903 in Kidder Township by state police at Fern Ridge. A test revealed the presence of a controlled substance.

He was assessed $600 and ordered to render 50 hours of community service and license suspended for 60 days.

Jamie Lynn Locher, 30, of Slatington, was placed for six months on a charge of retail theft. Locher was arrested on May 25 by Mahoning Township police at the Walmart store.

Locher was assessed $450 and ordered to render 25 hours of community service.

Colby Newton, 18, of Nesquehoning, was placed for six months on a charge of possession of marijuana. He was arrested on July 3 by Summit Hill police at the Ginther field.

He was assessed $450 and ordered to render 25 hours of community service.

Carolyn Michelle Wilkus, 18, of Hazleton, was placed on a charge of possession of a prohibitive offensive weapon. She was arrested by Weatherly police along Plane Street.

She was assessed $450 and ordered to render 50 hours of community service.

Each defendant must also pay court costs of about $1,000, a $50 per month supervision fee while in the program and those charged with DUI, must follow any recommendation of their drug and alcohol evaluation.
