Carbon County court – ARD
Eleven defendants in pending criminal cases were placed on Tuesday in Carbon County’s Accelerated Rehabilitation Disposition probation program by President Judge Roger N. Nanovic II.
If a person successfully completes all conditions of the program, their record is wiped clean. However, if they fail to complete the program, or are revoked from it, they would face trial on all pending charges. A person does not admit guilt in entering the program.
All were placed for a year, unless otherwise noted.
Lee M. Arner, 28, of Lehighton, was placed on a driving under the influence charge. He was arrested on April 29 by Lehighton police along East Street. A test revealed a 0.11 BAC.
He was assessed $600 for the cost of the program, and his license was suspended for 60 days.
Rosemary R. Brown-Goff, 39, of Jim Thorpe, was placed on a charge of aggravated assault for an incident on Sept. 29 along Lehigh Avenue involving Jim Thorpe officer Daniel Long as the victim.
She was assessed $450 and ordered to get a drug and alcohol evaluation and follow any recommendation for treatment and make restitution of $125.
Ryan Michael Cardoni, 31, of Palmerton, was placed on a DUI charge. He was arrested on Sept. 3, 2017, along Fireline Road in Lower Towamensing Township by state police at Lehighton. A test revealed a 0.17 BAC.
He was assessed $550, and his license was suspended for 60 days.
Michael Eric Desmond, 25, of Lehighton, was placed on a DUI charge. He was arrested on July 20 along Bridge Street by Lehighton police. A test revealed a 0.10 BAC.
He was assessed $500, and his license suspended for 30 days.
Matthew Ryan Diffley, 29, of Philadelphia, was placed on a DUI charge. He was arrested on May 26 by state police at Lehighton along Route 209 in Franklin Township. A test revealed the presence of a controlled substance.
He was assessed $600, and his license was suspended for 60 days.
Tyler Allen Hunsicker, 20, of Lehighton, was placed on a DUI charge. He was arrested on May 14 by Lehighton police along Route 443. A test revealed the presence of a controlled substance.
He was assessed $650, and his license suspended for 90 days.
William Aaron Klein, 22, of Kunkletown, was placed on a DUI charge. He was arrested on Jan. 27 by state police at Lehighton along Spruce Hollow Road in Towamensing Township. A test revealed a 0.17 BAC.
He was assessed $550, and his license suspended for 60 days.
Timothy P. Mulvihill, 50, of Lehighton, was placed on a DUI charge. He was arrested on June 16 by Lehighton police along Bridge Street. A test revealed the presence of a controlled substance.
He was assessed $600, and his license suspended for 60 days.
Colleen Maret Nickel, 59, of Palmerton, was placed on a DUI charge. She was arrested on Dec. 6, 2017, by state police at Lehighton along Lower Smith Gap Road in Lower Towamensing Township. A test revealed a 0.21 BAC.
She was assessed $550, and her license suspended for 60 days.
Stephen L. Stefano Jr., 33, of Bangor, was placed for six months on a charge of endangering the welfare of a child. He was arrested on July 8 by park rangers at Beltzville State Park, in the area of “A” lot in Franklin Township.
He was assessed $450 and ordered to get a drug and alcohol evaluation and follow any recommendation for treatment.
Ronald David Wenner, 64, of Lehighton, was placed for six months on a charge of false written statement in attempting to purchase a firearm when he was prohibited from doing so. Franklin Township police filed the charges for an incident on March 19 at Buck’s Sporting Goods along Indian Road.
He was assessed $450.
Each defendant must also pay court costs of about $1,000, a $50 per month supervision fee while in the program and those charged with DUI must follow any recommendation of their drug and alcohol evaluation.
