Carbon County court — DUI

Published November 19. 2018 12:22PM

Five people entered guilty pleas on Tuesday in Carbon County court to driving under the influence and related counts.

President Judge Roger N. Nanovic II accepted the pleas from the following:

Rhonda Lee David, 46, of Lehighton, was arrested on March 13, 2016, along Mill Road in Mahoning Township by state police at Lehighton. A test revealed the presence of a controlled substance.

Nanovic sentenced her to serve 90 days to five years in jail, a fine of $1,500, license suspended for 18 months and get a mental health evaluation and follow any recommendation for treatment. She was given credit for one day spent in jail on the charge.

She is currently an inmate in the county prison serving a parole violation term which runs to Dec. 19. Nanovic ruled his sentence run concurrent with the parole violation. After her release on Dec. 19, she will serve what is left of her 90-day term on consecutive three-day weekends beginning Dec. 21 at 9 a.m.

Robert Allen Cordery, 24, of Kunkletown, was arrested on June 3, 2017, by state police at Lehighton along Laurel Lane in Albrightsville, Penn Forest Township. Troopers responded to a reported hit-and-run crash. Cordery left the scene but was located a short time later. He refused a test. He was originally charged with 13 counts. He also pleaded to accidents involving damage to property, criminal mischief and driving under suspension.

Nanovic deferred sentencing so Cordery can obtain a drug and alcohol evaluation and also apply for placement in the county’s Intermediate Punishment Program — house arrest.

Jason C. Stermer Sr., 39, of Bangor, was arrested on July 14 by Palmerton police along Mauch Chunk Road. A test revealed a 0.15 BAC.

A first offense, he was placed on probation for six months and ordered to pay a fine of $300.

Mark Alan Foster, 55, of Kunkletown, was arrested on Nov. 16, 2016, by state police at Lehighton along Canal Street in Franklin Township. A test revealed a 0.30 BAC.

He was previously placed in the Accelerated Rehabilitation Disposition probation program but was revoked for violating conditions.

Nanovic placed him on probation for six months and ordered he pay a fine of $300.

Devin Michael Lutsko, 21, of Lehighton, was arrested on July 31 along North Street by Jim Thorpe police. A test revealed a 0.19 BAC.

Sentencing was deferred so he can apply for placement in the IPP.

Each defendant sentenced must also pay court costs of about $1,000, a $50 per month supervision fee while on parole or probation and follow any recommendation of their drug and alcohol evaluation.
