Carbon County court — probation/parole hearings

Carbon County judges recently conducted probation/parole revocation hearings on petitions filed by the adult probation office against defendants who violated the terms of their release.

James Muffley Jr., 36, of Weatherly, had his parole revoked on a driving under the influence charge on petition of probation officer Joseph Bettine for violating conditions by not making a concerted effort to pay court costs, failing to complete outpatient drug and alcohol treatment and failing to complete 25 hours of community service.

Judge Steven R. Serfass sentenced him to serve one to three months in the county prison effective April 1 at 9 a.m. However, if he completes the D&A treatment and 25 hours of community service and pays $300 on his court costs, along with his regular monthly payment, by that date the order will be vacated.

Kim Osborn, 58, of Kresgeville, had her parole revoked on a charge of persistent disorderly conduct on petition of Bettine for violating conditions by not making a concerted effort to pay court costs.

Serfass sentenced her to serve one month back time effective April 1 at 9 a.m. However, if she pays $600 on her court costs, plus her regular monthly payments, by that date the order will be vacated.

Samuel Lakata, 24, of White Haven, had his parole revoked on a charge of receiving stolen property on petition of Bettine for violating conditions by admitting using marijuana, being unsuccessfully discharged from the Salvation Army program and failing to report to the probation office immediately after his release from the Salvation Army.

Judge Joseph J. Matika sentenced him to serve 130 days back time in the county prison effective Aug. 6, 2018.

Jeremy Tobin, 40, of Tamaqua, had his parole revoked on a charge of possession of drug paraphernalia, on petition of the probation office for violating conditions by testing positive for a controlled substance, failing to complete drug and alcohol treatment and violating the zero tolerance condition.

Matika sentenced him to serve three months back time effective Aug. 30, 2018.

James Hunsicker, 51, of Nesquehoning, had his probation revoked on a charge of firearm not to be carried without license on petition of Bettine for violating conditions by not making a concerted effort to pay court costs, failed to obtain a drug and alcohol evaluation and follow recommendations and failing to complete 50 hours of community service.

Matika sentenced him to serve three to six months in the county prison effective at 9 a.m. April 1. However, if he obtains a drug and alcohol evaluation and follows all recommendations, completes 50 hours of community service and pays $2,640 on his court costs, along with his regular monthly payments, by that date the order will be vacated.

Valerie Weston, 34, of Weatherly, had her probation revoked on a charge of theft by unlawful taking on petition of Bettine for violating conditions by not making a concerted effort to pay court costs and failing to complete drug and alcohol treatment.

Matika sentenced her to serve one to three months in the county prison effective Nov. 20, 2018.

Jubalani Jones, 26, of Wilkes-Barre, was revoked from the Accelerated Rehabilitation Disposition probation program on a charge of possession of marijuana on petition of Bettine for violating conditions by admitting smoking marijuana, testing positive for marijuana, failing to pay court costs by his maximum date, failing to get a drug and alcohol evaluation and following recommendations and failing to complete 30 hours of community service.

Matika ordered the ARD revocation effective April 1. However, if Jones gets a drug and alcohol evaluation and follows recommendations, pays his court costs in full, completes 30 hours of community service by that date, the order will be vacated.
