Lehighton man admits sexual assault of girls

A Lehighton man admitted in Carbon County court on Monday afternoon that he sexually assaulted at least three young girls.

Daniel David Miller Jr., 24, pleaded guilty in two pending cases to two counts of aggravated indecent assault on a person less than 16 and one count of statutory sexual assault of a person between the ages of 9 and 16.

Miller was charged by Lehighton police after officers were called to Lehighton Area High School in November 2018 to a report of photographs of a naked 16-year-old female student being found.

The investigation revealed that Miller had sexual relations with two females, then ages 13 and 14, at his home. He also had then posed naked or gave them lingerie to wear.

The investigation also revealed that Miller had another girl, then age 15, meet him in a wooded area near South Fourth Street, near a cemetery. He had her take her clothes off and then gave her lingerie to wear. Police said while having the girls in both incidents take their clothes off, Miller took pictures of them with his cellphone.

Judge Steven R. Serfass, who accepted the pleas, told Miller that for the two aggravated sexual assault counts he faces a minimum prison term of anywhere between 22 and 36 months, and for the statutory sexual assault count, between 9 and 16 months. Those sentences would place him in a state correctional institution.

Serfass deferred sentencing since the charges fall under the provisions of Megan’s Law. Miller will be evaluated by the state sexual offenders assessment board to determine if he is a violent sexual offender. If it is determined he is a violent sexual offender, he will have to register for life as a sexual offender. Serfass also ordered the adult probation office to prepare a presentence investigation report.

Miller is an inmate in the county prison on the charges.
