Carbon County Court - Guilty Pleas

President Judge Roger N. Nanovic II accepted guilty pleas in Carbon County Court Monday.

David Argott, 42, of Lansford, pleaded to two counts of unauthorized use of a motor vehicle.

He was arrested on two occasions for taken vehicles without the permission of the owners. The incidents occurred on Sept. 23 and Oct. 6, 2018, both in Summit Hill.

Argott spent 150 days in jail on the charges, unable to post bail.

Nanovic placed him on probation for 18 months on each count, with the terms running concurrently, and ordered he make restitution of $1,250 for damages, which is a half-share, because of a co-defendant in the cases. The terms run consecutive to a probation sentence he is serving in Schuylkill County.

Michael Lloyd ludicello, 38, of Nazareth, pleaded to one count of terroristic threats. He was charged for an incident on Oct. 11, 2018, when Summit Hill police responded to a residence along East Hazard Street for a domestic incident. Police learned that ludicello threatened to shoot his wife at her place of employment. There were other threats made on Oct. 12 but they were not included in the plea bargain with the district attorney’s office.

Nanovic deferred sentencing and ordered the adult probation office to prepare a presentence investigation report.

Roman Tatarinowicz, 25, of Palmerton, pleaded to one count of accidents involving damages to attended vehicle (hit and run). He was arrested for an incident on Jan. 25 in Mahoning Township, when he was involved in a three-vehicle crash and then fled the scene. He was later located by police.

He said he fled because he had no insurance and the registration on his vehicle had expired.

Nanovic placed him on probation for a year and ordered he get a drug and alcohol evaluation.

Michael Gillen, 47, of Summit Hill, pleaded to one count of harassment, as a summary offense, with a charge of simple assault dropped in a plea bargain with the DA.

He was charged for an incident on Feb. 3 along East Richards Avenue by Summit Hill police. The female victim agreed to the plea bargain.

Nanovic imposed a fine of $300.

Chad Harrison Hartsell, 37, of Weissport, pleaded to one count of criminal trespass, a felony. He was charged for an incident on April 25.

Lehighton police responded to a report of unwanted people at a residence along Center Road. Hartsell was identified as one of two trying to enter the home.

Hartsell is currently an inmate in the county prison on the charge. Nanovic told him he faces a prison term, at the minimum end of between 9 and 16 months up to 10 years.

Nanovic deferred sentencing and ordered a PSI report by the probation office.

Daniel T. Spillane, 32, of Fleetwood, Berks County, pleaded to one count of driving under the influence of a controlled substance. He was arrested on March 24, 2015, along Route 248 at Bowmanstown by state police at Lehighton after being involved in a crash. He was previously placed in the county’s Accelerated Rehabilitation Disposition probation program but was revoked for violating conditions.

Nanovic sentenced him to serve 72 hours to six months in jail, a fine of $1,000 and a one year license suspension.

He was given credit for 10 days spent in jail on the charge and paroled.

Each defendant sentenced must also pay court costs of about $1,000 and a $50 per month supervision fee while on parole or probation.
