Negligence suit
Corey and Kathleen Eckhart, 245 Lehigh Ave., Palmerton; Lisa Nemeth, 243 Lehigh Ave., Palmerton; and Collen Kulp, 247 Lehigh Ave., Palmerton, have all filed a civil suit against Lowe’s Home Centers, 1000 Lowe’s Blvd., Mooresville, North Carolina, and Hearn Enterprises, 934 Delaware Ave., Palmerton.
The suit states on July 13, 2018, a fire originated at a propane tank located at the Lehigh Avenue property of Eckhart after it failed during intended use and leaked propane gas, which ignited and caused fire, heat, smoke and soot to spread throughout the property causing substantial damages to the properties of the three plaintiffs.
Negligence is alleged against Lowe’s because it “assembled, tested, inspected, sold, distributed, marketed the propane tank” in question. Negligence is alleged against Hearn because the tank was filled with propane gas by the defendant Hearn which required Hearn to fully inspect the tank for safety and advise the plaintiffs Eckhart of all deficiencies and dangerous conditions of the tank, but Hearn failed to do so, it is alleged.
Sought are damages in excess of $100,000 on each of four counts.
