Lansford man, who assaulted young son, given prison term

A Lansford man, who admitted assaulting his young son, was sentenced on Friday to a county prison term.

Judge Joseph J. Matika sentenced Joseph Daryl Mongi, 34, to serve 45 days to 23 months in prison on a charge of simple assault.

Matika said the defendant offered no remorse for what he did, adding, “regret is not an apology.”

Mongi, when speaking to the court, said he regretted what happened and told the court, “My main concern is for my children.”

Mongi, while holding a puppy in his arms and continuously petting it, said he had attended anger management counseling and is continuing counseling. He said the puppy calms him. He said he has a job and is paying child support, asking Matika for leniency.

Matika said, “I don’t know what effect this will have on the child.”

He said he was also concerned about information in a presentence investigation report prepared by the adult probation office in which Mongi made statements in conflict of the facts.

The mother of the child, now estranged from Mongi and living in the Lehigh Valley area, said Mongi has never apologized for what he did. She added, “He lets his anger get the best of him.” She also claimed that Mongi “ignores his children.”

Incident detailed

Mongi was arrested for an incident on Sept. 18, 2017, when Lansford police responded to a home along East Patterson Street for a report of an assault.

According to the affidavit of probable cause filed by Detective Joshua Tom, on scene Mongi told police his estranged wife was threatening him over marks on one of the children’s buttocks.

Borough police Chief Jack Soberick was met by Mongi and was shown a picture of three linear marks across the midpoint of the child’s buttocks. The redness surrounding the margins appeared to be finger prints and red lines that looked like scratches.

On Sept. 18, Carbon County Children & Youth conducted a Child Advocacy Center interview at the Lehigh Valley Children Hospital in Allentown. The mother of the victim transported the child to the appointment.

On Sept. 27, Mongi was asked to come to the station for an interview and agreed to meet with Tom.

Mongi told Tom that on Sept. 16 he took both of his children to a softball game, and during this time the victim wet his pants and needed to be changed. Mongi said that this happened several times throughout the evening and that he did not observe any marks on his son during these times.

Mongi said he FaceTimed his wife so that the child could say goodnight.

During this conversation Mongi admitted to his wife that he spanked the child for having several such incidents throughout the day.

Mongi said that he woke up in the morning and gave both boys a shower. During this time is when he said he first noticed visible marks on the one child’s buttocks. However, he said that he did not spank him to the degree that would leave these marks.

He was now claiming that the mother must have spanked the child sometime through the night on Sept. 15.

On Oct. 31, Mongi’s wife said that Mongi on Sept. 15 picked up her and the children and came to Lansford. She said that she put the child to bed that night.

On Feb. 6, 2018, the wife was interviewed with the assistance of the state police Cpl. Alan Pietkiewicz and ruled out as a suspect.

Mongi admitted during his interview that he lost his temper and he spanked his child; that he FaceTimed and also admitted to his wife that he spanked their son; and that Mongi’s allegations against his wife in this case were proved to be false.

The commonwealth agreed to drop charges of endangering welfare of children — parent/guardian/other commits offense, harassment and another simple assault count.

Prior arrest

In April 2014, Mongi was sentenced on six counts of recklessly endangering another person and one count each of simple assault and persistent disorderly conduct to a total of four to one day less 24 months in prison followed by one year of probation.

He was convicted by a jury on Jan. 10, 2014, of the charges that were filed by Mahoning Township police in a road rage incident that led to a crash on Oct. 23, 2012.

It was noted that Mongi had his young son in his truck with him.

In addition to the prison term, Mongi was ordered to get a mental health evaluation and follow any recommendation for treatment, attend and successfully complete an anger management course, attend and successfully complete parenting classes, render 50 hours of community service when paroled, have no contact with the victim, pay court costs of about $1,000 and pay a $50 per month supervision fee while on parole.

He will begin the prison term at 9 a.m. on Aug. 1.

What is wrong with you DEN MCLAUGHLIN? Part of reporting the news is getting all the facts and not from a women convicted and sentenced to fraud, forgery and theft from an 82 year old veteran. By the way why didn't you report mom's crimes and her failure to admit to her crimes when she sentenced and the courts failure to allow the victim to speak at her sentencing? Why did you refuse to report the failure of the carbon county DA's office in prosecuting mom for theft of a vehicle, theft of money from other individuals, fraud and forgery for forging signatures on checks? Why was her plea agreement still upheld at her sentencing when she refused to admit to the crime and accused someone else of doing it even when it was determined to the extent of IP address and phone number of who actually committed the crime? I saw no remorse there, no admit of guilt, no attempt to apologize to the victim or the court, no regret! Why did you fail to report she used the Judges nephew in court at her sentencing as an attempt to defend herself? This is clearly misconduct no only on your behalf but that of the court and DA's office. Just for the benefit of the public it was ADA Michael Greek practicing out of Lansford and running for DA.

Also for the public, according to DA Jean Engler, "they (the DA's office) can do what they want and do not have to take into consideration what the victim wishes", spoken directly to the 82 year old veteran who was the victim! Wow, this is chief law enforcement office of Carbon County. Not impressed!

Mom was present at the home and she admitted to putting the child to bed. The child was upset and crying when she did so. She took two polygraph tests, first one she failed and the second one was inconclusive. Mom refuses to follow court orders directed by court order to do so, yet you feel she is a reliable source of information.

Thank you for printing a date for the start of the sentence. Now if his property is vandalized you can be held responsible by notifying everyone of his absence.

DEN MCLAUGHLIN you sit in the court house day after day like a leach sucking the life out of this broken system and those impacted by it. It is apparent you have no clue how it works. Are you aware that individuals will act according to the advice of their legal council? This individual plead guilty as directed to do so by his attorney as a part of a plea agreement. Does dad feel he failed to protect his child in this situation, yes, he does. Did you see the photos, speak to the witnesses? The Lansford police department did not interview witnesses either, Officer J. Tom.

But spanking a child it is now crossing the line of corporal punishment? I hate to think what would have happened to my parents when I was spanked with a belt or wooden spoon. What has this world come to?

Shame on you for bringing up a service animal. As the Judge stated in court that was not pertinent to the case.

You obviously have no clue what this individual, his children and his family have been through at the hands of of this woman you so clearly wish to stand by.

Shame on you for bringing up a past incident. This individual was sentenced, completed everything that was required of him on time and successfully. It is time to let it go already.

The justice system of Carbon County is to say the very least broken and needs to be addressed.

The above comment was clearly left by Joseph Mongi’s mother. She has done nothing but slander the mom of the children since she escaped with her children in March of 2017. It has not only been determined by criminal courts but also civil courts in Lehigh county that Joseph Mongi is a danger to his children and so is Joseph’s family and they are allowed no contact with the children as per a final custody order granted in august 2019. The above comment about the mother is false. It was proven that it was in fact Joseph who redeposited a check to frame the mother for leaving him in a way to scare her to return to him with the children. The mother has been threatened by Joseph and his family on multiple occasions since leaving Joseph and filling for divorce in 2017. They continue to use the court system and false allegations against her as a scare tactic and means to control her. Also as for the stolen vehicle there was no such thing Joseph just doesn’t want to admit he could not afford said vehicle and it was repossessed by the bank with in 6months of the mother leaving him. Who ever left the above comment get your facts straight. Joseph did beat his son. It is public record when he was starting his incarceration. He showed no remorse for anything he has done to his two small children. He does not pay child support of $209 a month for two children. He works as a part time grave digger just to say he has a job. He has no responsibilities because his mother pays for everything for him and condones all his actions. The mother never failed a polygraph and only took it once. Again clearly the above person is someone from Joseph’s family who will just attempt to slander a victim of abuse and keep making her a victim of lies in order to make their son look like a good person.
