Structured settlement

Shawn Filchner, 178 Avenue A, Palmerton, and Stone Street Capital, LLC, Bethesda, Md., have filed a structured settlement petition seeking court approval of an early distribution owed Filchner as a result of an injury claim.

The petition states Filchner is entitled to receive monthly payments of $677 through Nov. 7, 2016, and $2,450 payable monthly beginning June 7, 2025, and continuing for life. The obligation was funded through the issuance of an annuity by the Genworth Life Insurance Company, Lynchburg, Va. Stone Street Capital is a company in the business of purchasing future periodic payments.

The petition asks the court to transfer the 46 payments of $677 to an aggregate amount of $31,142. Less a federal discount rate and legal fees, costs and expenses associated with the processing of payment, the parties are asking the court to approve a payment of $21,500 to Filchner, which, the complaint says, he plans to utilize to make improvements to his home.

As the payee, Filchner shall retain all right and interest in the remaining payments not assigned.Mortgageforeclosures

MTGLQ Investors, L.P., West Palm Beach, Fla., has filed a mortgage foreclosure complaint against William J. and Robin N. Klotz, 291 White Spruce Way, Jim Thorpe, over a property at that address, which is located in the Marty Axman in the Poconos development. Sought is $235,549.75 plus interest.

DLJ Mortgage Capital, Inc., Houston, Tex., has filed a mortgage foreclosure complaint against Anthony Gadaleta and Patricia E. Gadaleta, 974 Pohopoco Drive, Lehighton, over three parcels in Franklin Township. Sought is $346,890.27 plus interest and costs.

Defaults on credit

NCEP, LLC, Norcross, Ga., filed a credit card default complaint against Mandi l. Reiss, 633 Mauch Chunk Road, Palmerton. The plaintiff is seeking judgment in the amount of $3,596.36, plus interest and costs of the suit.

FIA Card Services, Inc., Greensboro, N.C., filed a credit card default complaint against Duane A. Ramaly, 100 Mill Road, Aquashicola. The plaintiff is seeking judgment in the amount of $22,076.18.

Judgments appealed

Equitable Ascent Financial, LLC, Cherry Hill, N.J., has filed an appeal of a magisterial district justice decision that was rendered in favor of Francine Craigie, 44 W. Sixth St., Jim Thorpe.

Magisterial District Judge Edward M. Lewis, Jim Thorpe, ruled in favor of Cohen on Dec. 6. The case is a debt collection/credit card action.

Charles Christopher and Jennifer Jenkins, 9 Wenro Way, Jim Thorpe, have filed an appeal of a magisterial district justice decision that was rendered in favor of FDL and Associates, P.O. Box 265, Lansford.

Magisterial District Justice Casimir Kosciolek ruled in favor of the plaintiffs on Nov. 29 in the amount of $3,784. The case is a landlord/tenant dispute.

Northeast Site Developers, Inc., 21 Old Stage Road, P.O. Box 1750, Albrightsville, has filed an appeal of a magisterial district justice decision that was rendered in favor of Brian Jay Cohen, d/b/a RC Electric, 18 Jeans Drive, Jim Thorpe.

Magisterial District Judge Edward M. Lewis, Jim Thorpe, ruled in favor of Cohen on Dec. 18 in the amount of $8,790.
