Suit over death

Patricia Bortz, 607 W. Washington St., Slatington, individually and as administrator of the estate of Victor Bortz, deceased, has filed a civil action against Tuthill Corporation, 1660 Blue Mountain Drive, Palmerton, over the death of Victor Bortz.

The suit states at times relevant Victor Bortz was employed by Linvengood Excavators Inc. for paving and excavating services. The defendant hired the firm to assist in grading operations on the slopes of its ski area.

On Sept. 21, 2011, Bortz was involved in grading operations using a Volvo A30c articulating hauler to transport 17 tons loads of soil from the leading area to the area that the defendant was grading.

The suit states further that Bortz had to drive the hauler up a steep temporary haul road that was installed by the defendant. During one of those trips up the road suddenly Bortz lost control of the hauler.

The hauler backed down the road, traversed a crossover, traveled across a row of shrubs, subsequently tumbled down an embankment and struck a large ski lift tower.

Bortz was ejected from the hauler and came to rest under the right front wheel of the cab, the suit states. Bortz was pronounced dead at the scene, the suit adds.

Negligence for the death is alleged in the two count suit which seeks damages in excess of "an amount which exceeds the arbitration limit" of Carbon County.
