Woman, who failed to appear to start prison term, given another jail term
A Carbon County woman who failed to appear to start a prison term imposed by the county court last year pleaded guilty on Monday and was sentenced to another prison term.
Brandice A. Boner, 39, of Lansford, and who was formerly of Nesquehoning and Tamaqua, pleaded guilty in two pending cases to one count each of default in required appearance and possession of marijuana.
The default count stems from her not appearing to begin a jail term imposed on her by President Judge Roger N. Nanovic II in May 2018. She was sentenced to serve 11 to one day less 24 months in prison on charge of criminal use of a communication facility. She was to report on May 4 but did not appear and a warrant was issued for her arrest. The drug count stems from an Aug. 30, 2018, incident in the 300 block of West Patterson Street filed by Lansford police.
Court-appointed defense counsel attorney Matthew G. Schnell said since her incarceration Boner has taken advantage of all programs available in the county prison for drug abuse. He said Boner has a long history of drug abuse. He also noted she spent 60 days in an inpatient rehabilitation program, successfully completing it and then returning to the prison to continue serving her sentence imposed by Nanovic.
On the default count, Matika sentenced her to serve three to 18 months in prison and 15 to 30 days on the drug count, with the terms running concurrently.
Matika also ordered Boner to get both drug and alcohol and mental health evaluations and follow any recommendations for treatment, supply a DNA sample, pay court costs of about $1,000 and must submit a pre-parole plan concerning where she will be residing after he released and that must be approved by the adult probation office. The sentence runs concurrent with the term imposed by Nanovic.
