Fuel delivery driver charged with DUI

A Lehighton man whose fuel tanker flipped over on Route 209 in Mahoning Township earlier this month has been charged with driving under the influence of a controlled substance.

According to the affidavit of probable cause filed by Mahoning Township Police Chief Audie Mertz:

At 8:55 a.m. Jan. 8, Mertz was dispatched to an oil truck rollover on Route 209 at Beaver Street.

The home heating oil delivery truck from D&D Fuel on its roof blocking 209.

The truck had flammable liquid placards on the front sides and rear.

A large volume of home heating oil was flowing from the truck, and the fluids traveled down both sides of the roadway into storm drains, and onto adjacent properties until the tank was empty.

Some of the fluids made it into the Lehigh River through the storm drains.

The Pennsylvania Fish and Boat Commission reported an oil sheen was visible at Bowmanstown on the river.

The driver, Dennis Ruch, 66, refused medical treatment and denied being injured.

When he initially spoke with Ruch, Mertz asked him what happened.

Ruch said the road wasn’t treated and he lost control traveling downhill on Beaver Street.

Mertz observed S-shaped tire tracks in the snow/slush on Beaver Street starting around 400 feet uphill from the final resting point of the truck.

Ruch was asked to submit to a blood test and he consented, with the results showing the presence of Delta-9 Carboxy THC: 16 ng/mL, and Delta-9 THC: 2.2 ng/mL.

The truck, a 2000 Sterling tanker, has a registered gross weight of 33,000 pounds.

Before the crash, the truck was carrying about 2,080 gallons of heating oil, and 300 gallons of kerosene.

An inspection of the truck by state police showed there were no DOT numbers assigned to the truck.

The inspector determined there were no mechanical defects that would have contributed to the cause of the crash.

Ruch faces charges on three counts of driving under the influence of a controlled substance; as well as one count each of reckless driving, careless driving; driving vehicle at safe speed; and accidents involving overturned vehicles.

He is scheduled to have a preliminary hearing Feb. 26 before District Judge Eric M. Schrantz of Jim Thorpe.

He should get help because he's a good guy who helps others he'll deliver $20 worth of fuel to keep a family warm if that's all they can afford he hits ice n flips his truck n now gets DUI because he smoked over the weekend way to go Mertz instead of screwing with a guy who goes above and beyond to help others why don't you try some real police work n get the scumbag herion dealers who are killing kids ???
Just because a guy smokes LEGAL marijuana maybe the night before, or maybe over the weekend, whenever. Does not mean he was still messed up in any way. The dui/marijuana laws are too loose and it’s easy for a cop to say your impaired. It’s a lot harder to prove an innocent mans innocence then for a cop to claim his guilt. It’s like fighting your way out of a brown paper bag. If he would have refused to go for blood he’d been charged with the highest tier dui, loose license for a year, then get breathalyzer for the whole following year, and prob hasn’t even smoked pot for days. This man has been driving that truck for over 20 years. Surely it’s not the first time he smoked on Friday and worked Monday morning. If the roads (especially steep hills) would be salted and taken care of properly, he would not have slid, would not have rolled, and the lives of him and his family would not have been ruined. Dui is nothing more then a business. All about the money. If u haven’t gotten at least one, don’t point fingers cuz you could be next!
Were you there ? For your information the roads were treated 15 minutes before he made a bad decision to go down a snow covered hill. For your bright knowledge, salt doesn't work instantly, It takes time to work. Don't blame someone else for his bad decision. For your info. When you have a CDL there is no marijuana use accepted at all. Find your facts before you open up your mouth. Remember it was a snow SQUALL. The township workers cant be everywhere at the time of a squall. They have a lot more roads then Beaver street.


I'm with you. Pot stays in your system for a long time. You have all these know it alls throwing stones. I'm sure he showed no signs of impairment. No smell. No mention of finding any weed or roaches in the truck. Just, as you pointed out, it can stay in your system for quite a few months. 1 of these legal, BS things that always bothered me.
I would venture to guess this man was operating this vehicle on prescription medication. He got a raw deal here. His meds probably state do not operate heavy machinery or drive. Unit you know how this medicine effects you. It’s not like he was using meth or drinking.
Really. Raw deal? First off. No dot sticker is a violation. Second its hus only truck n that supports him. He should have more common sense. N third his fines will b double lead since he has a cdl.
