Plans revised for manure storage building

Justin Cunfer has submitted revised plans to build a 60-by-260-foot agricultural building on his parents’ East Penn Township property.

East Penn supervisors rejected an initial set of plans in April, saying there was no written authorization from Deanna and Dennis Cunfer, who own the land, to show Justin had permission to build there.

No action was taken on the revised plans Monday night as supervisors said they would go before the township planning commission on May 15.

“There is nothing we can do on it tonight,” said East Penn supervisors’ vice chairman John Strockoz, who ran the meeting in the absence of Chairman William Schwab.

The building is proposed for heavy use and manure storage. Justin Cunfer said last month it would not be used to store biosolids.

The township and the Cunfers are currently awaiting a decision in a court battle over the family’s plan to use the material as fertilizer on the farm.

Planning commissions from both East Penn and Carbon County recommended conditional approval of the initial set of plans. The conditions included a developer’s agreement with the township, financial security for all site improvements, a construction cost estimate, an operations and maintenance agreement for a proposed infiltration trench and diversion channels, stormwater management easements, payment to the township for the stormwater maintenance fund and new trench calculations.

The project, Justin Cunfer said last month, is funded in part through the National Resource Conservation Service.
